This website is operated by Daytripper ("Daytripper," "we," "us," or "our"), a Canadian cycling apparel brand based in Ontario.

Daytripper provides this website, including all information, products, features, and services available through daytripper.cc (the "Site"), subject to the following Terms of Service ("Terms").

By accessing our Site, browsing our products, or placing an order, you agree to these Terms and any additional policies referenced herein, including our Privacy Policy, Return and Refund Policy, and Shipping Policy.

Please read these Terms carefully. If you do not agree, you should discontinue use of our Site.

Our online store is powered by Shopify, which provides the ecommerce platform through which we offer our products.

2. Products and Availability

Daytripper designs and sells cycling apparel, accessories, and related products. Our collections may include limited-edition releases, seasonal products, pre-orders, and custom club apparel.

We make reasonable efforts to ensure that product descriptions, photographs, colours, sizing information, and specifications accurately represent our products.

However, slight variations may occur due to manufacturing processes, fabric characteristics, screen settings, and differences between production batches.

Certain products may be available exclusively online or in limited quantities.

We reserve the right to modify product offerings, limit quantities, discontinue products, or update prices and descriptions without prior notice.

Such changes will not affect orders already accepted, except where otherwise agreed with the customer or permitted by applicable law.

3. Product Sizing and Fit

We aim to provide accurate and helpful sizing information to assist customers in selecting the appropriate size.

Our size guides, product measurements, fit descriptions, and any automated sizing recommendations are provided for general guidance.

Fit may vary depending on individual body proportions, personal preferences, garment construction, fabric stretch, and intended use.

As our cycling apparel is designed with performance and fit in mind, some products may fit differently from conventional everyday clothing or other apparel brands.

Although we strive to provide helpful recommendations, we cannot guarantee that a particular recommended size will meet every customer's individual fit preferences.

Nothing in this section limits your rights under applicable consumer protection laws or our obligations where products are defective, misdescribed, or otherwise fail to meet legal requirements.

4. Pricing and Payment

All product prices are displayed in the currency indicated on our Site or at checkout.

Prices may change without prior notice, but changes will not ordinarily affect orders that have already been accepted.

Applicable taxes, shipping fees, duties, and other charges will be calculated or disclosed during checkout where required.

We reserve the right to correct pricing or calculation errors.

If a material pricing error affects an order, we may contact you to confirm whether you wish to proceed at the corrected price or cancel the affected order and receive a refund.

Payments are securely processed through Shopify and supported third-party payment providers.

By placing an order, you confirm that you are authorized to use the selected payment method and that the payment information provided is accurate.

5. Orders and Order Acceptance

After placing an order, you will generally receive an email confirming that your order has been received.

An automated order confirmation does not necessarily mean that an order has been accepted for fulfillment.

We reserve the right to review, decline, or cancel orders for legitimate reasons, including:

Product unavailability
Suspected fraudulent or unauthorized transactions
Material pricing or product information errors
Shipping restrictions
Inaccurate or incomplete customer information
Orders that appear to be placed for unauthorized resale

If we cancel an order after payment has been collected, we will refund the amount paid for the cancelled items, including any applicable charges that must be refunded by law.

We may contact you to verify order details or request additional information before fulfillment.

You agree to provide accurate and current billing, shipping, and contact information to allow us to process and deliver your order.

6. Pre-Orders and Made-to-Order Products

Certain Daytripper products may be offered for pre-order or produced following the placement of an order.

Estimated production, availability, and shipping dates may be communicated on the product page, at checkout, or through subsequent order updates.

These dates are estimates unless expressly identified as guaranteed delivery commitments.

Production schedules may be affected by manufacturing capacity, material availability, quality control, shipping logistics, customs processing, or circumstances outside our reasonable control.

Where significant delays occur, we will make reasonable efforts to notify affected customers and provide updated information.

Orders may be shipped in separate packages when products become available at different times.

Any additional shipping charges for split shipments initiated by Daytripper will be disclosed or agreed upon where applicable.

Cancellation, return, and refund eligibility for pre-orders will be governed by our Return and Refund Policy and applicable consumer protection laws.

Nothing in these Terms removes any statutory cancellation or refund rights arising from delayed or undelivered goods.

7. Custom and Club Apparel

Daytripper may offer custom-designed or specially produced cycling apparel for clubs, teams, organizations, and other groups.

These orders may involve unique designs, custom artwork, specific size allocations, minimum order quantities, or production timelines.

Custom orders may also be subject to separate written agreements covering design approvals, pricing, deposits, production, delivery, and cancellation terms.

Where a separate written agreement has been entered into, that agreement will govern the relevant custom order to the extent of any inconsistency with these Terms.

Customers or organizations providing artwork, logos, or other materials for custom production confirm that they have the necessary rights or permissions for their use.

Once production has commenced, modifications or cancellations may be restricted due to the customized nature of the products, subject to applicable law and any separate agreement.

8. Shipping and Delivery

We ship to destinations made available through our checkout.

Shipping costs and available delivery methods are displayed during checkout.

Delivery times may vary depending on destination, product availability, carrier operations, customs processing, and other factors.

Where products are shipped internationally, customs duties, import taxes, brokerage fees, and related charges may apply.

Any charges collected by Daytripper at checkout will be identified during the purchasing process. Where additional charges are the customer's responsibility, we will disclose this where required.

Customers are responsible for providing complete and accurate shipping information.

If an order is returned due to an incorrect address, failed delivery, or refusal of delivery, additional shipping charges may apply, where permitted by law.

Risk of loss and responsibility for goods during delivery will be determined according to applicable law.

9. Returns, Exchanges, and Refunds

Daytripper generally operates an exchange-focused return policy rather than offering discretionary refunds for changes of mind.

Eligibility for exchanges, return conditions, applicable time limits, shipping responsibilities, and any exclusions are detailed in our separate Return and Refund Policy.

Certain products, including custom-made or personalized apparel, may be subject to additional restrictions disclosed before purchase.

All returns and exchanges must meet the requirements of our published policy, except where applicable law provides otherwise.

Nothing in our policies excludes or limits a customer's statutory rights relating to defective, misdescribed, undelivered, or otherwise non-compliant products.

This includes the unauthorized reproduction or commercial use of our original apparel designs, prints, graphics, and brand assets.

These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles.

Any disputes relating to these Terms will be subject to the jurisdiction of the courts of Ontario, except where applicable consumer protection laws provide customers with mandatory rights to pursue claims in another jurisdiction.
